CNMC experts from Spain and the ACA of Albania have exchanged experiences with the objective of enriching the Albanian competition system
The Spanish National Commission on Markets and Competition (CNMC) and its counterparts from the Albanian Competition Authority (ACA) have met for the first time in the framework of the Twinning project on ‘strengthening the capacities of the Albanian Competition Authority’ (ACA), funded by the European Union and managed by FIIAPP.
This first activity has focused on the analysis of ACA resources for the organisation and conduct of on-site inspections at companies’ premises.
During the three days while the activity was carried out, the CNMC experts and ACA inspectors exchanged experiences on procedural and regulatory issues of the dawn raids carried out by both institutions in relation to the use of forensic tools. In this regard, the legal aspects, human and material resources used to prepare and execute these inspections were analysed.
During the project implementation, as legal aspects, the legal powers attributed to a Competition Authority within the framework of on-site inspections will be analysed, such as, for example, the power to enter premises and the power to collect hard-copy documents.
In relation to human resources, the analysis of competition inspectors and IT staff stands out, as well as the assessment of the software and devices used to gather information during dawn raids, known as Forensic IT (FIT).
In addition, as a continuation of this activity, during the week of October 7 to 11, ACA’s inspectors will have the opportunity to visit the headquarters of the CNMC in Madrid and watch in situ the work developed by their Spanish counterparts in the preparation of on-site inspections.
